Notwithstanding the many previous legislative attempts in the US, it is undeniable that the presidential initiative played a catalytic role in the passage of the US law aimed at sanctioning the non-consensual disclosure of intimate images generated by deepfakes. It should be noted that for more than fifteen years, the US Congress has been considering various proposals to regulate and prohibit the disclosure of intimate images, but to date no comprehensive and effective federal regulation has been achieved.
In this regard, I emphasise that any legislative development that recognises and criminalises the unauthorised dissemination of intimate material, especially when it disproportionately affects women and persons in vulnerable situations, not only serves a preventive and punitive function, but also reinforces international human rights standards, particularly those relating to privacy, dignity, equality and non-discrimination. Therefore, Karen, I believe that this legislation provides a legal framework consistent with US constitutional mandates and commitments under international human rights law.
